| 摘 要： | 把保证的目的建立在"当债务人不履行债务"时,保证"履行其债务"或保证"债权人的债权实现"上会造成一系列理论和实践上的问题.保证的目的就是保证债务人不违约,以及保证人承担因债务人违约而造成的后果.根据这一目的便把主合同解除与保证合同一系列复杂的关系简单化了--那就是主合同解除与保证合同并没有必然的关系.

| Abstract: | Establishing the goal of guarantee on "if the debtor fails to pay a debt',the guarantor shall 'perform the debt' or ensure 'the realization of creditors' rights'" can create a series of problems.The author believes the goal of guarantee is that the debtor will not breach a contract,and the guarantor bears the responsibility caused by that the debtor breaks the contract.According to this goal the complex relations between dissolution of the principal contract and the guarantee contract will be simplified___they have no inevitable relations. |
