信访制度变革的法理学思考

当前,我国学术界发起了一场关于信访制度的存废之争,双方各执一词,两方看似均有道理,但信访制度的存在不是单单研究是存还是废便可圆满解决的问题,它涉及国情、民情等许多不可避免的实际问题,因而"存必改之,废必缓之",使信访制度既要成为预防社会失控的安全阀的同时,又要扮演人民自力救济的最重要的法宝.
