| 摘 要： | 禁止宅基地使用权流转制度已不适应我国市场经济发展的内在要求,实践中已形成错综复杂的宅基地使用权的"隐形市场",给日后交易双方引发纠纷留下了隐患,严重影响了社会的稳定。法律与现实的脱节,凸显了现行制度的内在矛盾,并导致了司法的困境。宅基地集体所有制是宅基地使用权流转的最大制度障碍,我国农村集体所有制本身存在着诸多不合时宜,成为了农村经济社会发展的阻碍之一,改革势在必行。通过集体土地国有化方式,使宅基地使用权流转的制度障碍得以克服。
