| 摘 要： | 本文在我国大陆与台湾罪数形态立法和理论研究方面进行比较的基础上,提出了我国的刑法立法中应当规定罪数形态的处断原则,并应当将罪数理论简单化,同时提出了有关罪数的刑事立法、司法和理论研究必须有一个宏观的刑事政策视角。
