论行政正当程序的预防腐败功用

当代行政法体现了正当程序价值理念的行政公开、公平、公正原则,要求行政权力的行使,始终以尊重个人主体尊严和保护个人权利免受公权力的不当干预和侵害为目标。保障行政相对人权利是正当程序适用的核心问题,也是有效预防腐败的关键所在。为此,应制定统一的行政程序法典,以正当程序规范执政党的执政行为,严格领导干部公开选拔的正当程序。

On the Preventing Corruption Function of Administrative Due Process

Contemporary administrative law reflects the values of due process of administrative openness,fairness and justice,requiring practice of executive power always subjects to respect for individuals dignity and protect their rights from inappropriate intervention and abuse of power.Protecting the rights of the executive relative is not only the core of due process application,but also the key to effective prevention of corruption.Therefore,it＇s necessary to establish a uniform administrative procedure code to constraint the governing behavior of CPC,as well as strict due process of open selection of leading cadres.
