我国城管执法的现实困境与对策

由于城管执法主体不文明执法、城管执法的工作性质、法律地位的不明确以及政府城市管理理念的滞后等原因,目前我国城管执法陷入了在执法力量和强度不断加强的情况下仍然成效不足的执法“失灵”的现实困境。通过采取转变城管执法理念、在具体政策上更多地体现执法相对人和公众的权益、加强非政府组织在城管执法中的运用、完善城管执法相应的法律法规以及配套制度的建设等对策,可以有效地使城管执法走出困境。

The Realistic Predicaments and Countermeasures in the Urban Management Enforcement in China

As for the abnormal enforcement of the body of the urban management enforcement,the work nature and the legal state's uncertainity of the urban management enforcement,and the hysteresis of the urban management enforcement's management concept,the urban management enforcement has been in the realistic predicament that although the strength and intesity of the law enforcement have been enhanced,the law enforcement malfuction still appeared.The urban management enforcement can be out of the predicament if these countermeasures are taken: changing the law enforcement concept,more rights and interests of the enforcement relative people and public being reflected in concrete policy,strengthening the application of non-government organizations in the urban management enforcement,perfecting the relative laws and the building of supporting system.
