“把法律作为修辞”的建构及其进路

法治意识是法治国家的内在灵魂,当前"把法律作为修辞"是法治意识的核心形态。"把法律作为修辞"强调的是相对于其他话语类型,法律话语对主流思维方式的约束意义与建构价值。"把法律作为修辞"的建构,前提上强调从权力修辞向法律话语的转变,在具体内容上需要法律话语系统的优化建构、法律话语权的内外塑造。"把法律作为修辞"的方法进路,实质是通过运用法律方法将法律话语细致化;"把法律作为修辞"的制度进路,是通过系统化的制度机制将法律话语实践化。

The Construction and Methods of “Taking Law as Rhetoric”

The ideology of government by law is the inherent soul of the countries under the rule of law, the focus of which at present is ＂taking law as rhetoric＂. Compared to other speeches, it emphasizes the meaning and value of legal speeches restricting the formation of thinking modes. For the construction of ＂taking law as rhetoric＂, the emphasis on the premise is the change from power rhetoric into legal speeches, and the construction and optimization of legal speech system and the formation of legal speech rights inside and outside should be conducted in details. As for the methods of ＂taking law as rhetoric＂, its nature is to elaborate legal speeches by legal methods; and for its system establishment, legal speeches should be put into practice through systematic mechanism.
