| 摘 要： | 随着社会的发展、人类文明的进步,社会所激发的对未成年人前科消灭的制度需求日益凸显。基于宽严相济刑事政策的出台与现代刑罚理念的变迁,未成年人前科消灭制度已是必然趋势与理性选择。这不仅有利于避免"犯罪标签理论"带来的负面影响,更有利于整个社会的和谐稳定。未成年人前科消灭的制度建设是一项系统工程,其中的实体要件、程序要件、形式要件的构建与设计至关重要,缺一不可。在该系统工程的建设过程中,还需加强配套制度的补充与完善,例如,政府对未成年犯的支持与鼓励、社会宽容文化的培育与引导,共同服务于"和谐稳定"之时代主题。
