行政职义——一个取代行政职责与行政职权相对应的概念

“行政职义”是针对“行政职责”而提出的，行政职责是传统行政法学中的概念，通说是指行政主体及公务员的义务。而按照通常的理解，“职责”含有一定责任的意思，用“职责”来表示义务容易给人一种“责任前置”的假象，毕竟职责不等同于责任，而且在实际适用中也会引起某种混乱，因此，如果用“行政职义”代替“行政职责”，就能很好地厘清行政职权、行政职义、行政责任三者之间的关系，并能强化行政法的行为规范和义务规范意识，为公民和行政机关及公务员提供双重的行为指引。
