法律的人本关怀及可能的危险——关于司法实践中“认真”对待民意的思考

面对当代中国突出的社会问题，新时代的马克思主义法学在发展中有所超越，无论是群众感觉论，司法大众化抑或民生司法，都强调以人为本，在司法实践中认真考虑民意，体现了中国法律在解决现实问题上的独特的“政治智慧”。但是，我们必须保持清醒的认识，极端的民众司法可能严重冲击改革开放三十年建立起来的极其脆弱的法治传统，极易导致极端的“民粹主义”，影响甚至误导中国法制发展进程。
