| 摘 要： | 政府采购已成为许多国家包括发展中国家管理公共支出,调节经济运行,维护本国利益的基本制度和重要手段。政府采购行为的法律形式是政府采购合同。政府采购合同有别于普通民事合同的显著特征,也具有突出的政策功能,从而使其具有了经济法意义。

| Abstract: | The government purchase has already become a basic system and important tool for administration of public expenditure, regulation of economic function and protection of the interests of many countries including many other developing countries. The legal form of government purchase is contract of government purchase. The contract of government purchase not only has prominent character different from common civil contract, but also has dramatic function of policy, both of which have made it has significance of economic law. |
