| 摘 要： | 在行为不符合特别法条规定的构成要件，但符合普通法条规定犯罪的构成要件时，由于法条之间不具有排斥关系，因而应以普通法条追究行为人刑事责任；以普通法条追究刑事责任可以实现刑法的任务；可以实现形式上的合理性，利于保护嫌疑人、被告人的合法权益。
