| 摘 要： | 本文从中日对钓鱼岛屿主权之争的依据人手，分析了日本对钓鱼岛屿的主权主张不符合国际法及以往国际法院判例所确定的原则，并明确了国际法在解决中日钓鱼岛屿主权之争中的作用，阐明了中国对钓鱼岛屿所拥有的无可争辩的主权。

| Abstract: | This article begins with the analysis of the justifications of disputes of the sovereignty of Diaoyu island between China and Japan, points out that Japan＇s claim is not in conformity with the relevant international law and the doctrines made by the Court of the International Law, the clarifies the significance of the international law in the settlement of the dispute and China＇s definite right. |
