公安行政执法工具的规范化

对公安行政执法工具的限制是我国行政法治不可缺少的一个环节。然而,我国现行行政立法在规范行政权时疏于对公安行政执法工具的规范,致使公安行政执法工具规则规定的公安执法工具的范围过窄,要么就事论事,要么内容无序,要么操作性弱,等等。为此,必须加强对公安行政执法工具的法律控制,扩大对公安行政执法工具的认识。

The restriction on public security＇s administrative law enforcement tools is an indispensable link of the administrative law of our country. However, the current administration legislation of our country ignores the norm to public security＇s administrative law enforcement tools, which causes the range of public security＇ s law enforcement tools stipulated by the rules to be too narrow, which judge the case as it stands, or whose content is unordered, or whose operation is weak. Therefore, we must strengthen the law control to public security＇s administrative law enforcement tools and expand the understanding of public security＇s administrative law enforcement tools.
