| 摘 要： | 我国现行《刑法》对赌博犯罪的规制已经不能适应新的发展形势,因此,要在研究传统赌博犯罪的基础上,分析现行《刑法》规制赌博犯罪存在的问题和赌博犯罪出现的新情况,并结合新颁布的司法解释,对构建赌博犯罪的刑罚体系进行新的思考。
