| 摘 要： | 背信犯罪原是德日刑法中的一个概念。在我国的新刑法中 ,虽然没有设立普通背信罪 ,但却有特别的背信犯罪的规定。从这个意义上说 ,我国现行刑法对背信犯罪的规定是采用一种列举的方式。这样一种方式虽然有其弊端 ,但却有利于罪刑法定原则的彻底贯彻。不过 ,对于大量的发生在私营组织内部的相应背信行为 ,我国刑法由于没有相应的规定而显得无能为力 ,我们可以在适当的时候通过列举的方式在刑法上增加一些具体的规定

| Abstract: | In German and Japan,Perfidy crime is a normal kind of crime in their criminal law.There is no same crime in 97'criminal law of China,but there are similar special crimes in the Chinese criminal law.Chinese crime law enumerates some form of crimes related to perfidy crime.By this way,it is good for us to follow principle of a legally prescribed punishment for a specified crime,although this has some shortages.There is no relative regulation about perfidy crimes in private enterprise in China criminal law,so we can't regulate such crimes.We should add some special perfidy crimes in Chinese criminal law by enumeration. |
