罪犯感化教育的学理基础

摘    要:感化教育是现代监狱行刑的重要原则。人类的学习本性不仅使受教育成为必要,而且使其固定为社会化的一种需求。更重要的是,人性可以借助充足和完善的教育进行重塑。由于犯罪是一种社会化缺陷的反照,因而罪犯教育实际上是一个再社会化的过程。罪犯教育矫正的原理即在于通过良好教育使其重获守法的心理倾向,增强抑制犯罪的心理力量。从社会学、人性论与犯因性的学理角度来看,罪犯感化教育不仅事属可行,而且具有重要价值。

Abstract:Reformatory education is an important principle of modern prison execution.The human nature of study not only makes education necessary but also makes it a fixed social demand.More importantly,human nature can be remoulded through adequate and perfect education.Since crime is a reflection of social defects,the reformatory education of criminals is actually a process of resocialization.The principle for reformatory education of criminals is that criminals can regain the psychological tendency of compliance through a good education,and enhance the psychological force of suppressing crime.Reformatory education of criminals is both feasible and of great value from sociology,human nature and crime reason.
