公安教育改革视野下的刑法实务课程改革

公安部《关于加强和改进公安教育训练工作的意见》,要求公安教育训练工作以公安工作和公安队伍建设执法需要为导向,以加强公安队伍执法能力建设为核心,坚持实战牵引、贴近实际、以人为本、按需施教。在此要求下刑法实务以培养具有刑事执法能力的应用型人才为核心,立足于警察职业岗位的设置,打破传统刑法课程以刑法典的结构为教学内容的结构模式,以公安机关管辖刑事案件的分工为依据,适应警察办理刑事案件工作需要,在教学中针对不同专业,选取不同教学内容,使其具有针对性和适用性;教学方法采用以案例为中心的辐射教学法;贴近公安机关刑事办案工作,建立递进式的实践教学体系,即案例教学→模拟办案→顶岗实习。

Reform on Criminal Law Practice Course in the Perspective of Teaching Reform in Police School

Police training education should be oriented by the need of police work and law enforcement of police team construction with the core of stressing police law enforcement ability,should be carried out by insisting on real combat traction,being close to the reality,people-oriented,teaching according to the demands,which were regulated in ＂Ideas on strengthening and improving police training education＂ issued by Ministry of Public Security.Due to the demand,criminal practice should have the core of cultivating applied talents with criminal law enforcement ability,start from the set of police position,break through traditional criminal course whose teaching contents were based on criminal code.And it also should adapt to police＇s need in dealing with criminal cases with the division of police in the criminal cases control.In the teaching,students with different majors should be given different teaching contents so as to make the teaching more specific and applicable.The way of radiation teaching with cases as centre is suggested to use.We should be close to the real criminal cases and build progressive practice teaching system,which is to say cases teaching,next simulated cases handling,then displacement internship.
