| 摘 要： | 商业贿赂行为已成为我国市场经济发展中的一颗毒瘤,具有极其严重的危害性并已成为贿赂犯罪的一种最主要的表现形式,以商业贿赂犯罪为视角探究我国反腐败刑事法律重新建构的重心在于对我国反腐败犯罪刑事立法重新梳理后的重构上.因此,有必要对商业贿赂以及商业贿赂犯罪进行寻根溯源式的探究与挖掘,力图呈现一幅商业贿赂以及商业贿赂犯罪的全景,完善相关法律法规尤其是商业贿赂犯罪的刑法规制,以达重构我国反腐败犯罪刑法规制的终极目标,实现刑事法治.
