| 摘 要： | 既然交通肇事罪侵犯的客体是交通运输安全 ,那么它必须是发生在交通运输过程中或与正在进行的交通运输活动存在着关联 ,而交通运输是指利用交通工具并借助一定交通设施将人或物从一地运载到另一地的整个活动过程 ,因而交通肇事罪可适用于非机动车引起的交通事故 ,特定情形下火车、飞行器引起的交通事故。
