构建我国域名与商标权纠纷解决机制

域名作为网络的"门牌号",有着自己的属性。注册一个域名,可以用它来发布信息、刊登广告、交友聊天等等,这个小小的域名蕴含着无限的潜能。域名作为新的媒介,与传统的知识产权领域的商标、商号等发生冲突,特别是域名权益与商标权之间纠纷成为域名纠纷的主要问题。目前统一域名纠纷解决政策(UDRP),是国际域名纠纷解决机制最权威的依据。我国没有制定如同UDRP那样详尽的关于域名与商标权纠纷的解决规定。

Diversified Dispute Resolution Mechanism of Domain Name and Trademark Rights

Domain name has its own properties as a＂house number＂.We can use the domain name to release information, advertisement,dating chat and so on.Domain name contains unlimited potential.It often has disputes with the traditional trademark,trade name and so on.Especially the dispute between domain name rights and trademark rights becomes the main problem.At present,uniform domain name dispute resolution policy （UDRP）is the most authoritative basis of the internation-al domain name dispute resolution mechanism.We did not develop rules as detailed as UDRP rules to solve the disputes be-tween domain name and trademark.Based on the present situation in our country,the article specifically analyzes the causes of domain name disputes,and then puts forward the suggestions of perfecting our domain name dispute resolution mechanism.
