警察防卫权行使主观标准的重构

我国警察行使防卫权的主观标准方面尚不明确,权利行使面临着舆论质疑和制度约束的双重压力,主观上存在着危急情境难界定的困惑,进而导致客观上警察防卫难进行的现实问题。警察防卫权与正当防卫权有诸多相似之处,应当参考正当防卫理论中主观方面标准的防卫意识学说,在生命威胁原则大前提之下,采"防卫认识""防卫意志"的概然性标准重构警察防卫权行使的主观标准,保障警察防卫权的规范行使,保护人民警察自身及人民群众的合法权益。

Reconstruction of Subjective Criteria for Police Exercising Defense Right

The subjective criteria for police exercising defense right in China is still unclear, which leads to double pressure from public opinion and system restraint, confusion about defining the critical situation, and difficulty in carrying out self-defense for the police.There are many similarities between police defense right and justifiable defense right, so it is feasible to reconstruct subjective criteria for police exercising defense right with probability criteria of defense awareness under the premise of life threat referring to relevant theory in justifiable defense to ensure the standardized exercise of police defense right and protect legitimate interests of the police and the people.
