摘    要:《劳动合同法》对改变和平衡企业的劳动关系影响重大,反对该法实施的声音也一直存在。国际金融危机以来,众多企业生产经营出现困难,就业形势紧张,缓行《劳动合同法》被一些人认为是保企业、促就业的出路。本文认为,坚持以《劳动合同法》调整劳动关系是法制社会的必然要求,缓行劳动立法不是稳定就业的出路。解决就业及稳定劳动关系,须矫正劳动关系领域违法用工行为、扶持中小企业和挖掘就业机会、澄清对劳动立法的错误认识。
