| 摘 要： | 过失危险犯立法在国外尤其是德日刑事立法和刑法理论已经相当成熟,然而在我国,这一制度还是一个刚刚崭露头角的"新星",甚至很多学者根本不承认我国刑法立法中存在过失危险犯的立法例。笔者认为,我国是存在过失危险犯立法例的,而且过失危险犯的范围应该扩大。基于这样的论点,以过失危险犯之存在与提倡为切入点、进而提出了过失危险犯的具体立法构想。

| Abstract: | Criminal legislation and criminal theory concerning negligent and dangerous offenses are well developed in many foreign countries,especially in Germany and Japan.However,the system is completely new in China.Many scholars even hold that no articles about negligent and dangerous offenses exist in our criminal code.The author holds otherwise.In the author's opinion,Chinese criminal code should enlarge the scope of negligent and dangerous offenses.Accordingly,the author puts forward some practical legislative suggestions. |
