| 摘 要： | 大陆法系的留置权是何种性质的权利,学者们看法不一。一般认为有债权的留置权与物权的留置权之分。其实,如果我们从留置权的产生、效力和消灭这三方面来看,实质意义上的留置权属于物权,它表现了很强的物权性。

| Abstract: | Scholars have different opinions on the nature of the Liens in continental law system.Common viewpoint is that the lien can be divided into lien of the creditor's right and lien of real right.In fact,if we analyze the lien from its emergence,effect and extinguishments,the essence of the lien belongs to real right;it displays an obvious real right character. |
