| 摘 要： | 在现代社会，伴随工业科技的发展，由此而产生了各种重大的环境污染和破坏事件。基于公害因果关系之特点，建议摒弃刑法中传统的因果关系理论，采用疫学因果关系来保护公民的环境权。

| Abstract: | In modern society, there occur different serious of environmental pollution and damage alongside the scientific and technological development in industry. This paper, according to the causality of social effects of pollution, suggests that the traditional causationism in penal code should be discarded and the causality of epidemiology to protect citizens'environmental right should be adopted. |
