因罚款规约具有的效用、法律执行中的疏漏以及额外因素的考量,致使罚款规约在长须贡玛乡形成恣意、泛化的现状。同时,实践也证明罚款规约的功能是有局限的,面对罚款规约在治理乡村中存在的问题,要坚持村规民约合法化,调适和配置好自治、法治、德治之间的平衡以实现“软治理”,需要对罚款规约进行必要、合理的矫正。
