| 摘 要： | 刑法是社会价值的体现。现代刑法在惩罚的同时,也强调保护。刑罚价值的二元化体现 了刑法价值观上突出刑法保护性的变化;刑法的社会机能更凸现刑法的社会价值意义,即社会保护 机能与人权保障机能的统一。转型期的我国刑法在日益关注社会秩序和个人权利共同保障的同 时,应侧重对个人权利的保障。

| Abstract: | The criminal law is the reflect of social value.Modern criminal law emphasizes the protection during penalty.The double - rail penalty value manifested the protection change in value view of the criminal law; The criminal law's social function show significance of criminal law social value,namely,the unification of the social protection and the human right safeguarding function.China criminal law in the transferring time is day by day paying more attention to individual right than the social order together with individual right. |
