刑罚适用与未成年罪犯权利保障

对犯罪未成年人进行矫正的核心价值理念是"以保护代替管训、以教养代替处罚",这在国际、国内社会已达成共识。即对犯罪未成年人尽可能不适用刑罚,但对一些实施了性质恶劣、严重危害社会的行为的未成年犯罪人,给予一定的刑罚处罚,仍然是对其进行矫正的前提。但未成年罪犯毕竟不同于成年罪犯,即便判处了刑罚,对其刑罚的执行活动也要体现出未成年罪犯教育和改造的特殊需要,也就是说,未成年罪犯刑罚的执行必须在未成年罪犯矫正政策所内含的基本价值原则下进行。

The core value idea to carry on the correction on the crime minor is ＂protection replaces the reformation training,education replaces the punishment＂,this has turned mutual recognition in internationaland the domestic society.Namely the penalty should not be suitable as far as possible to the crime minor,to some bad underage perpetrator,who has the severely impair societ＇s behavior,has to give certain penalty punishment,which is still the premise to carry on the correction.But the underage criminal is different with the grown-up criminal,even if has condemned the penalty,which must manifest the special need in education and the transformation,i.e.,the underage criminal penalty＇s execution must go under the core value principle which the policy contains to carry on.
