关于我国侦查权的理性思考

通过对我国侦查权的立法与实践考察发现,我国侦查权在配置、行使、监督等方面存在一定的问题。因此,借鉴法治国家的成功经验,改进检警关系,构建司法审查机制,加强对侦查权的指导与控制,才能解决我国侦查权存在的问题,从而确保侦查效率与人权保障目标的实现。

Rational Consideration on Investigation Power in our Country

Considering legislation and practice of the investigation power in our country,we will find there are quite problems in disposing,enforcement and supervision.So,we should learn from the successful experience of the country governed by law for reference,and improve the relations between the public procurator and the police,construct the mechanism of the administration of justice,strengthen the guidance and control on the investigating power,and solve the problems that exists in investigating power,and guarantee the goals of the investigating efficiency and human rights.
