论法律的自我建构

本文运用社会心理学的个人——社会方法分析了通过法律的自我建构过程,强调了"自我"这一概念对于法律的重要意义。自我是人类意识中理性的部分,具有通过经验环境的参照进行反思的功能。法律是构成自我反思的经验环境之一,法律为自我反思提供了参照。作为人工的构成物,法律上的人具有普遍平等性、自治性和实践性。自我在发展过程中完成与法律的相互认同,通过法律实现自身的社会化。

Self-construction of the Law

In this article,the author uses the individual-society method to analyze the course of the self-construction through law.The "self" is an important conception for law.The self is the rational part of human's consciousness.It can re-consider on itself through experience circumstance.Law is one of the experience circumstance elements.The person in law is the frame of reference,which means legality,autonomy and practice.Selves and society can identify with each other,and selves get into society at the same time.
