| 摘 要： | 刖刑就是采用残酷手段强行将人体下肢的某一部分截断的刑罚。刖刑从产生到被废除,经历了一个逐步轻缓化的过程。这种由严酷走向轻缓的过程,既和西周统治者的"明德慎罚"思想密切相关,也与战国时期新兴地主阶级的"耕战"政策密切相关。废除刖刑是中国古代刑罚由野蛮走向文明的重要标志,值得深思。

| Abstract: | Yue penalty is cruel penalties in which a certain part of the human lower limb will be cut off by force. Yue penalty has experienced a gradual reprieve process from the generation to death. Such process from cruelty to light is closely related to both ＂Matilda careful punishment＂ ideological of Western Zhou Dynasty rulers, but also closely related to landlord class ＂farming war＂ policy emerging in the Warring States Period. To abolish the crimi- nal penalties is an important symbol of the ancient Chinese civilization changing from barbaric to civilization, which is worth considering. |
