| 摘 要： | 农村集体土地流转包括土地承包经营权流转和集体建设用地使用权流转。尽管政策和立法均在鼓励土地承包经营权流转,但受制于各种原因,目前土地承包经营权的流转仍然处于非常低级的阶段。日渐兴旺的集体建设用地使用权的流转,由于缺乏法律的支持,则一直处于一种无序的状态。因此有必要尽快对集体建设用地使用权的流转进行立法规制,并进一步完善土地承包经营权的流转。

| Abstract: | The sublease of countryside collective land includes the sublet of the right of running land based on contract and the right of employing collective construction land.Although sublet of the right of running land based on contract is encouraged by policies and legislation,it's still at the extremely preliminary stage due to various kinds of reasons.The increasingly developing right of employing collective construction land has been a kind of disorderly condition because of lacking legal support.Therefore,it's necessary to stipulate the fight of employing collective construction land through legislation as soon as possible and thus to further perfect the sublease of the right of running land based on contract. |
