| 摘 要： | 行政补偿制度作为法律体系中的一个重要组成部分。它直接源于宪法上损失补偿的规定。该制度的完善与否直接关系到宪法补偿条款能否在实践中得到有效地落实。行政补偿的产生和发展有其思想根源和历史渊源。同时,作为一项法律制度,其也是与对私人财产权宪法保护的宪政制度的不断完善密不可分的。西方行政补偿宪政制度的探源对我国整个行政补偿理论研究以及对推进立法实践有着重要的作用。
