人民监督员制度漫谈

作为对检察机关职务犯罪侦察权的一种监督制约机制，人民监督员制度正在全国范围内进行推广，但自该制度诞生之初便争议不断，诸多焦点问题亟待厘清。本文首先从该制度实施现状出发，进而通过与人民陪审员制度的横向比较探讨了立法时机问题，并对该制度的正当性基础进行了分析，文中最后提出了完善该制度的设想。
