| 摘 要： | 迁徙自由 ,从形式上看包括本国内的迁徙自由和国际间的迁徙自由 ,从实质上看是指人们通过空间的移动来实现定居、探亲、访友、继承财产、留学、就业、旅游和其他目的的自由 ,是主观和客观相统一的行动自由。迁徙自由权存在应有权利、法定权利和实有权利三种形态。迁徙自由权不是一种为所欲为的权利 ,必须受到法律的限制。

| Abstract: | Freedom of migration,formally,can be divided into national one and international one;substantially,it refers to the fact that people want to achieve such goals as residence,visiting relatives and friends,heritage,study abroad,employment,tour,and so on.It exists in three forms:deserved freedom,legal freedom and substantive freedom.Meanwhile,it is not a freedom to do as one pleases and must be limited by law. |
