权力多元下的乡村"法律"实践

权力多元主要是指存在于国家权力之外的社会权力与国家权力共同形成的多元存在状态.当前中国乡村社会纠纷解决是多元权力互动的结果,同时也是国家法与民间法互动的结果.权力的多元化要求社会规范的多元化,我们要重视和逐步适度放开社会自治自律规范的功能,否则不能满足现代社会的多样化价值追求和克服国家法的局限性.
