| 摘 要： | 危险驾驶机动车罪的规制体现了风险社会对于安全刑法的期待,而对于该罪行为的评价直接影响到＂实害结果＂的责任认定。鉴于司法实践中的困境,有必要对于危险驾驶机动车罪的构成要件认定采取适用可反驳的刑事推定原则。

| Abstract: | The regulation of dangerous dfriving criminal behavior embodies the safety expectations of the risk society for the criminal law.The potential damage offense effects the criminal liability of the result of actual damage.Based on the dilemma in judicatory practice,the refutable criminal presumption can be applied to the demarcation of the constitutive conditions of dangerous driving criminal behavior. |
