| 摘 要： | 由于地理位置、经济发展的差异导致少数民族民间法与刑法存在冲突,而解决的方法是,在民间法的基础上变通刑法。如果没有一部这样的变通刑法,则有可能出现民间法与刑法的断裂,从而导致该地区的无序。而现今有这样一部变通刑法,则可避免这种混乱局面的出现。
