论检察讯问存在的问题与对策——从一起故意伤害案谈起

检察讯问是指在刑事诉讼中的审查起诉阶段,由检察机关公诉部门的办案人员对犯罪嫌疑人进行的讯问。与侦查讯问、庭审讯问相比,检察讯问具有不同的功能和特点。实践中检察讯问在讯问前准备、讯问内容及笔录制作等方面均存在不足之处,究其原因主要有办案压力大、办案人讯问能力不高等。为充分发挥检察讯问的作用,应增强检察人员自身能力、与相关部门加强协调以适当分担工作。

The procuratorial interrogation is a kind of interrogation held by the investigators of prosecution department to the suspects in the review and prosecution stage of criminal proceedings.Compared with investigative interrogation and trial interrogation,procuratorial interrogation boasts its own functions and features.In practice,it also has disadvantages in preparation,interrogation contents and making records because of the high pressure and inadequate abilities of interrogators.In order to make full use of procuratorial interrogations,not only the capabilities of interrogators should be improved,but also should the coordination be strengthened between relevant departments to share the whore work properly.
