“上提一级”所引发的思考——职务犯罪案件审查决定逮捕权的归属

最高检作出的关于职务犯罪审查逮捕决定权"上提一级"的规定,此项改革有进步之处也有可能出现的问题。从长远来看,逮捕权应当进行司法化改革,应当由中立的法院来进行裁决,才能保障公正。就我国目前的司法现状来看,可以采取"三步走"的改革方针。

Thinking Resulted from "Decided by a Higher Level"

The Supreme People’s Procuratorate put forward that reviewing the right of deciding arrest concerning jobbery crimes be decided by a higher level procuratorate,which has made a progress but also may result in problems.In the long run,verdict should be made by a neutral court so as to guarantee the justice.Based on the current judicial situation,we can adopt the "three-step"policy of reform.
