论国外科学不端行为刑事治理制度的特点及对我国立法的启示

国外科学不端行为刑事治理制度呈现三大特点:充分尊重本国法律传统;注重刑罚方式以适应科学家与科研活动的特点;保持刑法谦抑性。在对科学不端行为的治理中我国刑法一直处于缺位状态,而目前所采用的道德、民事和行政措施等手段又未能取得理想效果。因此我国应把科学不端行为的治理纳入到刑法典框架下,并须进一步完善资格刑。

The Characteristics of Overseas Criminal System of Administering Dishonourable Science Behaviours and Its Enlightenment for Legislation in Our Country

Overseas criminal system of administering dishonourable science behaviours has three characteristics,namely to fully respect the legal tradition of one's own country,to attach importance to the suiting the ways of punishment with scientists and activities of scientific research,and to maintain the principle of criminal indispensability.As it is still an absence of administration of dishonourable science behaviours in our country's criminal law,ideal effect has not been achieved by means of ethical,civil and administrative measures.Therefore,the administration of dishonourable science behaviours should be brought into the frame of criminal code,and the qualification penalty should be further perfected.
