| 摘 要： | 各国针对商业贿赂犯罪进行了多层次的立法规制与司法监控。各国刑事立法所归纳的法益深刻影响着惩治商业贿赂犯罪的运作方向。英美与大陆刑法的商业贿赂犯罪立法例为我国刑法改革提供了可供参考的指向。需要谨慎采纳谦抑型与积极型的反商业贿赂犯罪司法经验。《联合国反腐败公约》对打击商业贿赂犯罪提出了全新要求。以比较刑法的视角纵览全球惩治商业贿赂犯罪的动态能够为我国刑事司法系统获取丰富的启示。
