程序正义的有限性——电影《马背上的法庭》观后感

目前在法学界都普遍接受了程序正义、程序至上的观点时,电影《马背上的法庭》所反映的事实却对此提出了质疑,在这里我们看到的更多的却是程序过剩,而对于此问题的出路并非在于舍弃程序而是要加强程序分流,同时完备程序设计上的不足。

Finiteness of Procedural Justice——On "Courthouse on the Horseback"

At present,while the field of law has accepted the concept of supreme procedural justice,facts reflected in the film of Courthouse On the Horseback have questioned about it.In the film,what we saw mostly is excess of procedure.However,the way-out is not to give up procedures but strengthen procedural diversion.At the same time,the defects of procedural design should be perfected.
