论警察权力的制约与保障--兼谈对《治安管理处罚法》中警察规范执法与执法监督的理解

警察权力的制约与保障是一对矛盾体,它们的矛盾主要表现在一方面人们需要足够强大的警察力量维护社会秩序,保证公共安全;另一方面人们担心警察权力过大会反过来侵害社会和公民权益,希望警察权力得到必要的制约和束缚.要求制约和保障警察权力的呼声都有其合理性,但又有其局限性.警察权力制约与保障的矛盾本质上是自由与秩序的矛盾,反映了社会精英与公民权利在现实利益面前的博奕.平衡警察权力与公民权利必须从各地区不同时期的现实需要出发,协调各种利益,综合考虑赋权、分权、制衡的最佳结合点.

On the Restriction and Guarantee of the Police Power: Talking about the Comprehension of Standard Law Enforcement and Supervision in the Punishment Law of Public Security Administration

There is a contradiction between the restriction and guarantee of the police power.On one hand,people need enough powerful police force to maintain social order and pledge public security;on the other hand,they worry that social as well as citizen's rights and interests will be violated by excessive police power,ant thus hope police be indispensably restricted.Calls for restricting and ensuring police power are reasonable but have their limitations meanwhile.The contradiction of restriction and safeguard of police power is the contradiction between freedom and order in essence.It reflects the struggle faced with practical interests between the social quintessence and citizen rights.Balancing the police power and citizen rights must be based on the reality demand in each area at different periods.
