转型时期农村经济纠纷的社会控制

转型时期农村经济纠纷社会控制应以秩序、效益、自由与公正为价值目标 ,通过诉讼与非讼手段进行控制。现阶段农村经济纠纷的社会控制体系包含公证、和解、调解、仲裁和诉讼。同时我国农村经济纠纷社会控制的立法应进一步完善并应有所突破 ,如强调农村经济活动主体处分权和选择权 ,明确承认市民社会中行业自治 ,将行业仲裁纳入统一的仲裁立法之中等。

On the Social Control of Economical Disputes in Rural Areas during the Period of Transformation

In this article,from the point of socialogy,the control of economical disputes in rural areas during the period of transformation is discussed. Order,efficiency,freedom and justice are thought to be the four aims of value for such control.On the basis of analyzing the social background,the significance of preventing and redoing these disputes is approved,and at the present stage,the social control system should be made up of notarization,composition,arbitration and lawsuits are asserted as well. It is also pointed out in this article that the corrosponding legislation must be further improved and developed:in rural economical activities ,the subjects rights of disposition and option be emphasized,trade autonomy and self_government be definitely acknowledged;trade arbitration be incorporated in the unified legislation of arbitration,etc.
