离婚及离婚后未成年子女的法律保护

在离婚中由于过多强调离婚自由,而忽视了未成年人的独立主体地位。因此,应将对子女有妥善安排作为判决离婚的原则之一,有未成年子女的不得适用协议离婚;将抚养费界定为未成年人个人财产,改变现行抚养费数额的确定标准,明确抚养费使用的监督权;建立抚养费的强制执行体系;规定离婚后父母对子女的权利和义务。

Legal Protection on the Minor Offspring of the Divorced Parents

In some cases of divorcement, independent and autonomous position for the minors have been overlooked in view of overemphasis on free choice of divorcement. It is therefore necessary to take appropriate arrangement of the children as one of the principles for judging the divorcement cases. Some other points have to be specified as: couple with minor offspring cannot be permitted to divorce in agreement; payment of upbringing the children should be specified as personal possession of the minors; current standard of payment for fostering the offspring should be changed; supervision right for use of fostering payment must be clarified; a forced implementing system of fostering payment ought to be established; rights and obligation for the divorced parent to their offspring should be formulated in a form of regulation.
