| 摘 要： | 我国离婚损害赔偿制度存在着不足，现实婚姻生活中也有建立婚内侵权责任制度的需求，但不能用婚内侵权责任制度修改离婚损害赔偿责任中的离婚要件。婚内侵权责任制度与离婚损害赔偿制度是并行的两个不同的制度，有着不同的功能、构成要件，两者在一定程度上存在着竞合关系。

| Abstract: | There is shortage in China＇ s divorce damages compensation system, and the reality of married life needs to set up marital tort liability system. But we should not amend the elements of divorce in divorce damages compensation using marital tort liability system. Marital tort liability system and divorce damages compensation system are two different parallel systems, and they have different functions, different elements and the competing relationship of the existence to some extent. |
