行政承诺不反悔论

行政承诺是行政权行使中的一个普遍现象,实践中存在行政执法中的承诺和行政管理中的承诺。相比之下,后者多于前者,即我国绝大多数行政承诺发生在行政管理领域。由于没有严格的法律依据和具体的法律规范,导致该范畴的承诺极易发生变化而形成承诺反悔,影响行政公信力的树立,损害行政立法权威和行政相对人权益。因此,从法律上保障行政承诺不反悔成为一种必然。行政主体在作出行政承诺时应当谨慎,行政承诺应当制度化、契约化和可诉化。在我国行政法治中应当构建系统的政府行政诚信体系。

On the No Regret of the Administrative Commitment

The administrative commitment is a universal phenomenon during the exercise of administrative pow-er,including the commitment in administrative enforcement and the commitment in administrative manage-ment. In contrast, the latter is more than the former, namely, the vast majority of China＇ mitment is in the field of administrative management. Since there is no strict legislative au s administrative com- thority and norms, re- suhing in the category of commitments easy to change and pull back, this will influence the building of the ad- ministrative credibility, and damage the administrative legislative authority and the interests of the administra- tive relative person. Therefore, it is inevitable to ensure the administrative commitment not to regret by law. We think the administrative subject should be cautious in making administrative commitment while administrative promise should be institutionalized, agreeable and actionable. We should build systemic government credit set up in the administrative nomocracy in China.
