摘    要:近几年我国城市房地产市场发展始终处在舆论的风口浪尖,这与我国城市房地产管理法还存在一些不适应可持续发展要求的问题是分不开的。我国房地产法存在下列问题:一是缺乏科学规划的规定;二是房地产市场发展失衡;三是房地产开发中缺乏科技性标准;四是商品房预售制度弊大于利。应通过下列措施完善我国城市房地产管理法。一是完善城市规划、建筑设计科学性规定;二是完善房地产监管制度,使之均衡发展;三是完善房地产开发中的技术性标准规范;四是废除房地产预售制度。

Abstract:In recent years, China' s urban real estate market has always been at the focus of public opinion, which is connected with issues that China' s urban real estate administration law can not meet the requirements of sustainable development. China' s real estate law has the following problems:First,it is short of scientific planning of the provision, second, the development of the real estate market has lost balance, third, the real estate development is short of technology standards, and the fourth is that the commercial house pre-sale system has more disadvantage than advantage. The following measures should be adopted to improve China' s real estate law. First, the scientific rule in urban planning and architectural design shoud be improved, second, to improve the real estate regulatory system for a balanced development,third,to improve the technical standards and norms in real estate development, fourth,to abolish the real estate pre-sales system.
